I don't think Apple was the point...
..., I think the point was some else had already done something like that. Just because someone points out a company did something, does not make them a zealot. Apple is an obvious choice for something that is innovative AND NOTICED. While Apple makes some pretty cool stuff, they are not the primary innovator; they usually find, refine, and integrate a good idea. (as supposed to other companies that just basically 'grab, steal, and throw in' ideas).

And sure actually getting a patent would be a deterent against lawsuits; while also being a deterent to other smaller companies, or single inventors.
I can see it now, every time someone comes up with an idea, the MS patent lawyers (as with EVERY other large company) say "Patentable, sure it is."
But I don't think this is what patents were created for.
