If the company is actually creating goods and services or actively licensing the patents to people doing do, there's already a cloud over their portfolio. If you have a patent for the left handed banana wrench, and someone else gets a patent for using left handed banana wrenches on ambidextrous bananas, then what do you do when it turns out ambidextrous bananas are where all the money is?
