There really is a simple solution to software patents.
The truth is that software evolves MUCH faster than just about anything you can think of. If the duration of a patent followed the same time curve we wouldn't have the issues we see today.

Imagine if software patents were only valid for say 3 to 5 years.

That would much more accurately reflect the real world we all work in.
