i agree with your litmus test, but...
I dont think software should be patentable. All software is a gui with a logical back end which is tied to a series of logical tasks each one with its own execution. the problem is that the language is the same no matter who programs it and lines of code could be exactly the same depending on the competency of the programmer.

Maybe instead of putting patents on software they should only be able to copyright the name.

Truthfully i dont think any one piece of sotware is unique, they all borrow from each other and thats why i dont think they should be able to be patented.
