Saying that Microsoft IP is in Linux is a good idea...
... and is probably a defensible assertion. But charging for it is so foolish I didn't believe Mr. Ballmer would make that mistake. And that Novell would have rejected an agreement requiring acceptance of that point.

My guess is that the final agreement issued will be much less controversial. If the question is whether Novell has violated provisions of the GPL, then some backtracking is essential.

Sometimes when one believes the best of people, that they will be astute and sensible, say, one is due to be disappointed.
