actually, it would be a good thing
say newer versions of the kernel uses the new clause that "any covenant with the devil protecting one distributor against attack will automatically protect everyone else", it would mean either m$ will have to accept it, or m$ and novell will be forced to sell only the current kernel but not distribute any future update...
