Web server, P2P, who cares?
Certainly not I. So what if YouTube or MySpace or whatever is put out of business? The managed with out them just fine. What you suggest is like saying we need to ignore heroin laws to keep the drug dealers from going broke.

Look, if places like MySpace or YouTube can make a go of it with cutsey videos of a sleeping cat, (whatever) more power to them but the flagerent disregard for the rights of PROPERTY OWNERS is both illegal and self defeating. Who do you really think is going to invest millions of dollars in a commercial production just to watch it and their rightful return on investment stolen from them?

Log on to either site and do a search for any recent movie or TV show. I guarantee you will find copyrighted works for each and everyone. Heck, you can find most popular TV shows split up in chunks and the poster prouldy brags about it.

These places claim they are "doing all they can" when it takes 2.3 seconds to find copyrighted works? BULL !!! Now you can rant at me like a mad man, it won't change the facts one bit and a jusge will surely see them as easily as anyone can.

Is there a precedence for closing them down? You bet there is;

"An Australian federal court has ruled that Sharman Networks, distributor of the Kazaa file-sharing application, is guilty of copyright infringement and must filter out copyrighted songs traded on its peer-to-peer network within two months. Federal Court Justice Murray Wilcox said in his ruling that it was in the financial interest of Sharman "to maximise, not minimise, music file-sharing" and ordered Australia-based Sharman, U.S.-based partner Altnet and several other defendants to pay 90% of the music industry's court costs."

And do keep in mind what you yourself pointed out, these files weren't even hosted on a server any where which means they had far less control over what was being shared. A claim niether of these outfits can make.

Oh, and why did the court rule this way? Because these companies were making a profit from advertizing and riding on copyrighted works to do it. Gere, sounds like YouTube / MySpace to me. But as I said, let it go to court and the lawyer says "Judge, name any popular TV show or Movie" and it takes the lawyer seconds to deliver copyrighted work to the bench.

We shall see what happens. But if the last few years have shown us anything, copyright enforcement is getting tougher and more expensive on offenders.
