You are missing the point...
Unlike the Safe Harbor provision for ISPs (where users pay for a
service, and the ISP service does not benefit from any content
the user posts), Myspace and some other sites actively benefit
from the content that their users post.

In fact, Myspace provides tools to their users to facilitate the
posting of music and video files. Myspace's entire business
model is built around selling advertising around this content
that others upload, so they actively encourage it.

The actual owners of the copyrighted works being published
(artists, publishers, etc.) get NOTHING.

Myspace is building its multibillion dollar valuation based on
other peoples' creative and intellectual property.

If I was a content owner, I'd be pissed too!

And if you think music or movies are priced too high, you don't
have to buy them. It's not like someone is holding a gun at your
head forcing you to buy, and you certainly don't need this
content like you need food, or shelter, or oil....so STFU!
