Three things
There are three things in this kind of case I believe are wrong.

1. It is wrong for a company to rely on the government to protect their business in this kind of manner. It is one thing to seek charges for corperate espianage, but to protect a company from its own consumers is ludicrous. If you want your consumers to be loyal to you, give them a reason to be loyal.

2. Government should not be involved in this at all other than to guarentee that there is no collussion between the companies on their behavior. If they all decide to provide reduced services individually, then that is one thing, but if they all meet in the Caymans for the weekend to decide what their offering will be, then there is a problem.

3. The customer should reign surpreme. The customer should have a lot more choice in access and content than he/she has today. Cable companies should have to compete not only with Satelite offerings, but it should be wide open. Any cable company should be able to come to town, any Satelite provider should be available, you should be able to get televission content from you ISP or Phone Company if they want to provide it.

In this world, the FCC will no longer be bound to make these difficult decissions. The FCC should not make them since nop one knows the future and what ramifications they will have. Let the market decide. If the market were truely this wide open, some one would offer better service for less, then someone else would bring out a new package to compete that is a little better. This game of leap frog would continue until the customer got the best service for the best price. Problem solved.
