there is no question there are patent and copyright issues, they need to be resolved, changing licenses will not negate them.
and trying to change to law is crazy, as it will fail.

Microsoft approached Linus Torvalds, and OSDL with an offer the do a side by side comparison between windows and linux for patent and copyright issues.

Torvalds and OSDL turned down the offer..

One can only assume Microsoft then turned to Novell with the same offer.

Novell being a bit more intouch with the Real World, took up the offer and made appropriate arraingements with microsoft.

Ensuring its continued success in the market place, as industry can trust them.

Industry, does not like Open Source's concept that you can take what you like from anyone else, without fair due to the rightfull owner of that patent or copyright.

Just because something "does not contain the same code" does not get you around patent rights.

As was explained by George, about NTFS.

NTFS, if its patented, its OWNED by microsoft, does not matter who invented it, they OWN the patent, so they have EVERY right to change people for using it.

Linux uses NTFS, so its breaching a patent,

Basically Open Source HAS STOLEN the NTFS standard, they did not need to, they have their own file systems, but you STOLE it to gain larger market share, THATS THEFT. common stealing.

not a good model for a community.

patents and copyright do NOT kill innovation, they promote it, with protection of your ideas there is NO reason to invent it, or to tell anyone about it if you do.

Innovation is NOT getting someone elses invention or IP and putting it in your OWN application. its just theft.
