And Linux companies would love to do the same
as why do they have patented code to begin with? Why have they not all junped to GPL3, where it forbids you to do so?

Given a reason, Red Hat and IBM would not hesitate to do so themselves. They only thing keeping them at bay is the fact that they are probally violating many of MS's patents, and would rather not have to go into battle unless their backs were to the wall.
