Fair use, what fair use?

In essence, the DMCA of 1998 eliminated fair use defacto. It is still a concept that covers the null set of available media. You may not get sued by using a snippet of media in the same sense that a cop may not stop you for speeding. Depends on the time and place. This unbalances the copyright law but as long as the media companies are making money from lawsuits and the taxpayer is paying for enforcement the scam will continue. When it becomes untenable it will be "reformed". The issue is a lot like right to privacy. It is the least well defined right in the constitution and is abused regularly. A group of citizens can file suit and try to define and/or extend it. The feminists had a good chance to clarify the right to privacy but they are only concerned with themselves (i.e. abortion) and the hell with the rest of us.
