What about fair use?
---If you didn't record it, it's not yours. Seems simple enough to me.---

Even if it's "not yours", you can still use it.

I didn't record the Rodney King video. Can I use it in my report for my sociology class? If I'm a newspaper, can I run a picture of a frame from the video in a story about the furor it has caused? Can I quote the dialogue used in a copyrighted movie in my review of that movie? What if I'm making a parody?
