Google/YouTube will argue that they are not responsible for the theft of intellectual property. It's the same argument that all PtP systems have used: "We don't pirate, we just facilitate piracy."

I suspect the only way that GoogTube can really protect itself will be if they force anybody posting a video to "sign" all sorts of disclaimers and affidavits that the poster has full copyright to all material being posted. (And we all know that is not the case: look how much of what's on YouTube uses unlicensed images and/or sound!)

Then the person or company pursuing rights violations can pursue the poster instead of GoogTube.

Highjinks ensue!
