HP Wimps Out
Although they used methods that may be illegal in some states, HP had the right to investigate leaks by employees and board members. It also had the right to investigate reporters. These reporters depended on the actions of employees which violated their contractual relationship with HP. By doing so the reporters opened themselves up to investigation by HP to some extent. The use of a fake employee by HP in an email to the reporter is perfectly OK. The use of pretexting skates close to the edge due to the involvement of a third party, the telephone company, but the telephone company has the responsibility to keep this kind of information protected by such simple activity as well.

Frankly, I don't think that HP has done much wrong given the fact that it was investigating an obvious contract violation encouraged by reporters. If I suborned an employee to get something from a company, I would expect that the company would react and investigate. Just because a reporter did it does not make it OK.

My main problem with HP at this point is that the company and the executives are caving to the politically correct faction and not asserting it's obvious right to protect itself.
