Either way, Dunn is still an accessory to a felony.
The only difference that her knowledge of how that data was collected could affect her is in what she can be charged with. If she's telling the truth about not knowing that the data was gained illegaly, the most she could face is possession of "stolen property." However, if she knew about the pretexting and still accepted the data, that would make her part of the conspiracy.

Regardless of her role, she still needs to be investigated.
