You simply have no way of A) knowing if it was personal. HP may well be paying for his phone as a company perk. This is very common with high level execs that make a lot of long distance calls. B) That having access to "personal" information wasn't part of his employement agreement. Again, it's not at all uncommon to have such a clause granting the company rights to do an investigation if warranted.

No DonnieBoy, it's not the same rule wage earners work under.
