The Supreme Court did not find the code Illegal
What the court found was that a company could be held liable if they promoted an otherwise legally neutral program they had created as a tool for copyright infringement in order to profit from it. They were very clear that it was that behavior and not the code that was at issue. To say otherwise would have jeopardized any and all applications that could allow some form of illegal file sharing including IIS, Apache, ftpd, BBS code, AOL and shoot for that matter the drivers for floppy disks. What distinguishes a P2P file sharing programs from say a virus is that the code may be used for many clear and legal uses. For example, Bittorent is used to to distribute many forms of legal software and content where there is a need share a large file where many people desire it but your own local server resources are limited or non-existent. Remember for all their bitching there is a huge amount of material on peer to peer networks that is legal and they themselves sometimes use these programs or derivatives of them to transmit their own content. The court essentially said you may sell these hammers but you may not promote them a tools for breaking in entry. Which makes sense.

Now you would have to be deaf, dumb and blind to think they are not trying to reinterpret and extend that opinion to mean more than it did. From reading the few comments I see here, it is clear some people are already buying that ignorant line of reasoning.
