It seems to work more effectively than the US system at present (where the individual has even less chance of funding an expensive court battle to prove their patents).

Open Source software would not be affected if the US patent system was brought in line with the UK where software (along with any mathematical formulae or mathematical algorithm) cannot be patented. You may protect it by copyright, trademark, or whatever other IP protection law you want to use. You may patent the use of software in a specific business process or machine.

Equally - under UK law you cannot patent anything that is already in the public domain. I believe even US law supports the idea that patents can be over-turned if there is proof shown of prior art - so your statement that no one can put something into the public domain is the usual hysteria that makes so many open source advocates look like fools. (Sorry to upset you but the majority of open source development is actually carried out by major corporations and companies with services or advertising to sell, not by volunteers working at home).
