Tax Payers benefit with first to file because of the tax payer supported grant projects. Case in point. The University of California at Berkeley is responsible for a lot of code pirated by Microsoft and used in its operating system products. The best example involves the IE browser.

The University of California patented the way a control is worked by browsers. Microsoft lost several legal cases over this patent and I believe the value of the pirated code was set at 380 million by several courts. Their failed argument has been based at least in part if not mostly on first-to-use rather than first-to-file.

Rather than pay back US tax payers (and state of california tax payers) and the current patent holder the 380 million, Microsoft management has choosen to design the latest flavors of its brower by legal strategy that appears to play with definitions of derivitive works to avoid the patent.

So today your IE browser will, through what I view as a wrapper, display an awkward press space bar to activate this control message where other browsers who have worked with the patent holders do not. But it gets worse.

Microsoft portrays this browser control display issue as a security one, rather than a patent one, and there is a security issue when the control is an Active-X one. But that isn't demonstratably true for Java Applets, another kind of control.

The software designed by legal strategy to avoid paying for the stolen code involves scripting - itself unsecure. But the scripting creates a bottleneck that very much slows down Java applets.

The myth that Aplets are slow is perpetuated by the scriping wrap solution which legal strategists at Microsoft must think gets them out of the 380 Million owed.

Hatch just rocks. There is no time limit on revenge and he really has nailed Neukom, the mastermind behind so much of Microsoft's wrong doing and current issues. Neukom far from retired at Microsoft. His influence is evident at Preston Gates and Ellis one of the Gates family law and lobby firms. His replacement at Microsoft came from another of the Gates family law and lobby firms, and the two have always worked closely together and are of like wrong thinking minds.

Microsoft managment would be so Kewl if it just allowed Applets to be coded for the IE browser as they were intended to be rather than through this script wrapper. That probably means reimbursing US tax payers on the patent issue. Hatch is encouraging that action. So should all IT professionals. Go Oz - do the right thing. Feer not Java
