Patents proved too important to leave to Thomas Jefferson's qualms. The easy-issuance 1793 Patent Act is not "irrelevant"; it's the statement of what the Founders wanted from patents.
And Jefferson himself later came to observe - and be amazed by - the outpouring of inventiveness that came from government assurance of monopoly for a period of time.
That's why I titled an earlier post "Invisible Hand". People seeking their own advantage further society.
Concerning your analogy, the farmer puts the carrot in front of the ass to obtain work. But the flaw in the analogy is that the patent-seeker can believe himself certain to receive the carrot, rather than having it remain tantalizingly in front of him. (That was Jefferson's 1791 plan.)
Patents are about certainty and the assurance that comes from the assistance of government. From the point of view of the inventor, that's the main point. Society's benefit can wait, as shown by the legislation extending copyright. - Posted by: Anton Philidor Posted on: 07/23/06 You are currently: a Guest | Members login | Terms of Use
