I can't wait to see how this plays out in court.
I doubt it will play out. Bush only has 2.5 more years in the White House and legal actions of this sort take forever. My prediction: The next administration will disavow the current administration's actions, EFF's suit will go away on the grounds that it's no longer relevant, and AT&T will get executive pardons for anything they may or may not have at the NSA's behest.

Then, next time, the NSA will just try to be more careful not to get caught.
