More misguided blaming the victim

How will the broadcast flag ensure that commercials are seen? We both know it will not stop shows from ending up on p2p networks. It will, however, force people to pay for copies of shows they miss, copies on dvd or downloads which will not contain commercials.

It strikes me as really terrible bargaining to give up major concessions in a contract and gain nothing in return.

I've denounced pirating repeatedly over the last 3 years. I work in publishing and make my living from copyright. Infringement is wrong, and should be illegal.

Guess what? It made no difference.

Furthermore, let's suppose that tomorrow, all p2p networks, all filesharing, all infringement disappeared. Do you think the networks and studios would no longer want a broadcast flag? It gives them the ability to prevent you from recording a show, so you now will have to pay them to time shift or space shift. That sounds like a great deal for them, a way to make lots and lots of extra money. Do you think they'd just ignore this new stream of revenue because of some sort of "social contract"? I don't think that would be the case at all.

So if they're not willing to honor the social contract, why should I?
