Thanks, Let explain the flag if I may.
The flag realy is nothing more than a "flare" that says hey, this is copyrighted works.

At that point, it is up to the hardware to decide how to record it, say with a 90 day life span, that surely accounts for time shifting needs. It may also place DRM in it that allows you to move it to other devices you own, but not to any device on the planet. Again, it's all up to the hardware and the software behind it. The flag is just a, well, it's a flag is all.

Certainly the content industry will require some things in their contracts with hardware OEMs concerning the use of the flag, but I suspect the public will have a great deal to say about them (again, it is a social contract even if some don't grasp it) and a more or less balanced compromise will be made.

Concerning net neutrality, I agree that not getting it throught now is sad but believe when I tell you that dog has lots of fight left in him. Its not if it passes, its when. wink
