Do you even KNOW what you're talking about?
They went to the "courts" with complaints that it was "Unfair" that MS's search bar would be part of IE (which is how I meant it, sorry for the confusion). Seeing that there's probally little chance of having it removed, they took the only route left to them, which is a smart move.

While it IS true that IE 7 has a search bar more or less permanently placed on the top of the menu bar, it's ALSO true that you're NOT stuck NOR forced to use MSN search. In fact, you can configure the search bar in IE 7 to default to Google, or Ask.com by default in IE that's included with Vista Beta 2.

There's also an option that opens a link so you can configure additional "generalist" search tools (such as Yahoo, Lycos, & AOL as well as "specialist" search engines - such as Amazon, Monster, MTV, eBay, wikipedia and a host of other search engines that are available.

In fact, the only thing missing from the list would be search engines like dogpile (are they even still around?) that submit your search to multiple search providers from one query.

So, for what it's worth, Google has no NEED to sue. Their search engine is already bundled with IE 7.
