"Google is smart to not depend on the courts and pay billions if necessary for placement"

They went to the "courts" with complaints that it was "Unfair" that MS's search bar would be part of IE (which is how I meant it, sorry for the confusion). Seeing that there's probally little chance of having it removed, they took the only route left to them, which is a smart move.
