I am as much for protecting Intellectual Property as the next one, but I cannot help but laugh with glee when the (ill)logic of one party steps on the upside down lawn rake of technology and whacks them in the face. If I have paid for the license to fair use of content, where and when I choose to use that license is of no concern to the licensor. The concept of long distance and timeshifting is anachronous with regard to content. Just as VOIP is decimating landline business, and just as there are no long distance websites (Ed Whitacre's beliefs to the contrary notwithstanding)the concept of limiting fair use because of distance of the licensee is nonsensical. Is ten miles OK and 11 miles too far? It is totally arbitrary and manipulative on the part of MLB and I'm pretty sure the courts will se it that way.
