I think Symantec just figured out they held the patents

The Symantec/Veritas Merger was only complete in the first part of 2005. It's possible that it took their lawyers this long to figure out that Microsoft might be infringing on one of the patents that they picked up in the merger.

Generally, companies that sue Microsoft (or other giant firms) over patents are really using it for leverage in some other area like cross-licensing agreements.
