It's not 4 million
You can't use 4 million. How many of the patents that were reviewed because of complaints? Far less than that 4 million I would guess. How many of those were invalidated? That's the real question. If only a couple hundred were reviewed, then it would obviously be a common practice. However, if a quarter of them were reviewed, this would be quite uncommon. In addition, how many of those 151 were unheld as invalid in the end? To see if there's a pattern here, these are the questions that would need to be answered. (BTW a good journalist would have answered these questions in the article, but this is zdnet after all).
