Discovery Vs Invention
Even if was currently an unknown concept, you could not patent gravity.

In the same way if you find a new element on the periodic table, a new mathematical or logical proof, that is a discovery not an invention. To think otherwise is to suggest that Christopher Columbus invented America as opposed to discovering it.

It is also possible to observe what other people are doing and give it a name, but that does not make it an invention, only a discovery. A lot of software patents are not inventions but just a defining of what is going on in the world.
