In any settlement, the lawyers from both sides get together and work out the best deal for their clients or agency. In the MS anti-trust trial it was MS and the justice department.

While the lawyers for MS did their best to get the best deal for MS, the lawyers for justice didn't have to take it and the judge didn't have to approve.

Remember for justice to get more than they did, they would have had to go back to court where there would have always been the chance that based on what the appeals courts said, they would have gotten less than they did. That is why almost every anti-trust case in the last few years has ended up in a settlement.
