Lets actually think about the implications..
Our website resells various types of equipment. I have had complaints by companies who manufacture the items we sell complain about us using their company name in keywords, and in our online listings.

IF this sort of ruling is upheld, and the complaintant wins the case - think about the results.

It would then become illegal to advertise your 2003 Chevy Malibu for sale - on the web or in a newspaper since both Chevy (and Chevrolet) and Malibu are trademarked names. You'd have to advertise it as "some sort of 2003 US manufacturered car named after a beach". The same rules would apply to used-cars sold by dealers.

The implication is much more than has been presented here - if this goes forward - ALL resale of any trademarked item will be severly impacted.

Think about it.. do we want this? It would simply kill Ebay.. and a lot of other businesses.
