It's not the same.
In the brick and mortar situation you describe, you still get the info that there is a difference. In search engines there's no definitive corelation stating that you've got the wrong place or product. In fact a lot of scammers use that to their advantage to steal your login info from bogus e-mail messages, think about that for a second. Then re-compair the real world to this.

I do hope that this case wins. It boils down to not only trademark infringement, but also copyright problems, and false advertising to name only a few other issues in this area.
