Who's culpable?
This is all pretty weird.

I am not sure who is culpable here, Google or the person that buys the advert, or no one at all?

Did these companies violate fair use, commit fraud, or violate a trademark? It does not look like fair use, and not really fraud, and I am not sure if a keyword can be trade-marked. Where does free speech fit in here?

The only thing I know is that the lawyers are going to get paid. heh heh...
