Self incrimination...
If the files they were expecting to find were to incriminate him in an illegal act of wrongdoing, his lawyer should have argued that deleting the files was akin to him pleading the fifth. That aside, it's a scary day when judges apply the rule of law based on what they think a written contract should have said instead of it's actual verbiage. Occasionally in contract disputes there is grey area that judges need discretion to interpret. This clearly isn't an example of that.
