Intent and ownership are key issues.
There's more to it than the simple reactions posted so far.

1) as an agent/employee of IAC, information/files/documents that he created while employed by them are technically owned by *them*, not *him*.

2) the laptop did not belong to him, but was also the property of the company.

3) deleting files *after* the employee/employer relationship was terminated is a no-no, no questions asked. Once that relationship is terminated, authorization to do this or that is revoked. Whether it was a laptop still in his possession, or a server located in a locked room makes no difference; he wasn't authorized to do anything with the data.

4) deleting files *before* termination could be a stickier place to be, because then you have to prove intent, and content of the files comes into play. If a person deletes files, and they believe that deletion of these files would be in some way detrimental to the company, that's malicious intent and can get you in all sorts of trouble.

So it's not about whining on the part of a company... it's about an ex-employee removing data from company-owned computers. That's called 'hacking'. In this case, they know who did it.
