You're the one who's not listening. What is IBM going to indemnify? What Linux do they sell? Answer: none.

IBM isn't giving the wrong impression to anyone. It's these clueless "parrot the party line" "analysts" that are suddenly all aghast over software liability issues. "Why isn't IBM indemnifying their users?" they ask. Strangely, we haven't heard the "why isn't MS indemnifying their users?" call.

Your original position was: if I doesn't harm IBM, then why don't they simply do it? You note elsewhere that modifying cars voids warranties (which isn't 100% true but raises an important point). Well, IBM doesn't sell the "car" in question, and if they did they've stated that the conditions required for offerring indemnity destroy the whole purpose of the "car".
