Your points are valid, but it's not clear what you are taking issue with.

Yes, IBM is about business. The company will make use of open source products only as long as they contribute value to the customer and can provide profit, either directly or indirectly, to the company.

And you can bet that, if a valid threat came along to hazard sales, IBM would seriously consider consider the cost/risk avoidance of indemnification. At this point, it seems doubtful the SCO case would fall into this catgory. More likely it will serve as a warning against fallacious suits.

But really, you've answered your own question.
