Judge has no choice...
Lets say (hypotheticaly) you got busted for pot. You go to trial in say July. At the same time your state legalizes pot effective the coming January 1. Guess what? Yup, your still going to jail.

The judge must follow the current laws and dictates. As of right now these patents are valid.
