How RIM settles a dispute over patents that have been invalidated by the Patent office is beyond me.
Granted the Judge was deciding whether to impose an injunction or not, but all they had to do was hold out until all the patent decisions were final.
I guess the CEO just couldn't stomach the risk...
I also can't figure out how the judge couldn't postpone the hearings until AFTER the patent decision were final. It's like sentencing a person to jail BEFORE you get confirmation that the DNA test was positive or negative.
Ahhhhh, there's GOT to be a better way.

I doubt it was only the CEO that made the decision. I'm sure the rest of the board of directors threw in their 2 cents worth at the decision table.

There IS a bit of a difference here in this situation. There was evidence that RIM used technology that was allegedly patented by NTP.

It would be more like being sent up the proverbial river for say, an alleged rape where the victim was found comatose and couldn't tell her side of the story. Never mind that you claim that the sex was consentual and when you left, she was fine. It's your DNA they found inside and she was beaten to a pulp. Of course, when/if the victim in this case woke up, you don't know what she might say - whether she would tell the truth - that it was consentual sex, or would fabricate something because she was upset that you weren't there to defend her from the attack.

A better way would have been to light a fire under the PTO's collective behind and get them to moving on making a decision about the last patent(s) that were still to be decided.
