OK, maybe I was a bit track. It's just that you're a tad difficult to talk ethics with.

"Would it be wrong of IBM to say we would rather cash out on it now instead of taking the time to gain income from licensing?"

What if I said "yes?"

This just doesn't fit in with the whole idea of patents. IMHO, the whole patent thing needs to be re-thought.

"Heck, how about a small guy that has a great idea, maybe a prototype, but can't afford to build a manufacturing plant."

You know, people created inventions long before the manufacturing plant was commonplace .

Besides, there's no such thing as a "manufacturing plant" in the software industry - selling software over the internet has almost no cost compared to a physical manufacturing plant. Just set up a website and a shopping cart, and have them dowload it from the website.

You can even have somebody, say, CafePress, to manufacture and sell CDs for you.
