You bounced around so much, it's impossible to figure out what you're saying, claiming, or arguing. You say it should be different, and this (difference) would not happen in the same sentence?!?
The simple fact is that the consumer already pays for the pipe. It is wrong for the service provider to also have to pay for room on the consumer's pipe (yes, they have to pay for their own, is that your argument? Impossible to tell). Having the service provider pay is double-dipping, the broadband providers have already been compensated by the consumer for the pipe.
Also, the "broadband industry representatives on the panel assured senators that the companies they represent have never committed such discriminatory practices". You suggest that, in your example, one VoIP provider is currently getting preferential treatment because they do pay for a higher tier. This goes contrary to what the broadband industry is claiming; that they have not done this as yet. So, are you saying that the industry representatives are lying to congress?
