It's called truth in advertising . . .
This suit is not about forcing retailers to sell all games, or restrict retailers from selling some games. It is about being honest with the retailers who bargain in good faith about the contents of a game.

Those retailers represent themselves by what they sell. Many choose not to sell porn or its animated equivalent. Why should they trade money for "sheep" only to find out that it has a wolf inside?

Any retailer with wisdom will simply refuse to deal with any game maker/distributor who has ever misrepresented a game. What will that do for profits?

If game makers want to post mods and patches (remember the naked Lara Croft patch?), they can craft their code to accept it later while still selling an accurately represented (and rated) product on the retail shelf.
