"What they're trying to show is inadvertent viewing. They don't need to verify the age of people doing the searching. What they want to show, for example, is that someone who does a search on "bambi" would come up with porn."
And they don't need to subpoena actual records to determine whether a search for "bambi" would turn up porn. They could do the same thing you did to determine that so it still makes no sense. And if they want to see how many times a search for "bambi" was conducted it still doesn't tell them whether it was an adult or a minor looking for porn or whether it was an adult or minor that accidentally viewed it. The subpoena is still useless as anything other than a fishing expedition.

Of minors between the ages of 15 and 17, 70% have viewed pornography inadvertently. Id. at 133. The government has a compelling interest in addressing those serious problems.""
And once again they already have those figures if they are accurate from their survey. Since they can't determine the age of the person using the computer in the information they are subpoening the information tells them nothing they can use. Its just a fishing expedition.

Yes but the subject here is porn not ebay or Amazon.

And no the current survey doesn't ask for that information, that is what they are trying to require people to do, which if they do will make that information available to them.
With the information they're asking for, all they can do is compare search strings to what they turn up. That's it.""
