Jury of Peers
I think this just points out a flaw in the justice system and the reason why a "jury of peers" needs to be really thought out. What does a jury of peers mean? It means those people most like you, in approximate age and lifestyle, and/or your friends. With a jury of your peers set against you they will know what you are capable of, what they might do in a similar situation, what you've done in the past, and despite what some people think of as "logical" those people will be harder on you than strangers.

Today's jury selection is all about finding people who can't identify with a defendant. It's about finding people who can't use their own knowledge to discern events or the meaning of evidence. Both the defense and prosecution want people that can follow a lead, people who can just take whatever an "expert" says is true.

Having a jury made up of true peers I think would stop such non-sense. If you're going to try someone for hacking/cracking have some hackers on the jury - don't rely on "expert" witnesses.
