First if the studios agree, and why wouldn't they, then there is no violation of the DMCA. All Apple has to do is DRM the movie is tight little package and offer the software to put the movie on the IPOD.
Even if the Studios disagree with this practice it still is fair use. So all Apple has to do is document thier due diligence in getting the help of the copyright holder to do this act of fair use. If the copyright holder refuses to help, something not in thier best interest, then Apple is free to bypass the content protections in anyway they see fit. The copyright holder should not refuse here as they lose all imput.
