"This happens to you and now you cannot sue for a legitimate claim someone did to you for violating your copyright. The GPL states that you cannot sue for any copyright infringement if you use GPL code."

It does not say that. In fact it says that if you do not follow the terms of the GPL or the GPL is found to be invalid then you have commited copyright infringement, unless you made arrangements with every author of the code upstream of you or your use is consistant with fair use, and they can sue you for copyright infringement.

The GPL has Freedom or Death of the program... If you can not distribute derived GPL code under the GPL, then you can not distribute the program period. To do so violates copyright law of every author upstream of you.

If a rouge programer upstream of you mixes code they do not own with GPL code then that code has to be removed and rewritten before it can be distributed. If you distribute with that code then both of you have infringed. The same is true with non-GPL code though. What happens is the reverse of what you propose though- GPL code ends up in propriatary apps- The Sony rootkit contained some of DVD John's GPL code in it- DVD John howver hasn't felt the need to sue Sony and First 4 Internet for violating his copyright- at this time.

Also if you read Stallman's papers- He states clearly that he could care less if businesses adopt GPL software as that is not the primary purpose of the GNU project or the GPL and that there are plenty of other more business freindly licenses.

From a User standpoint it's great because the GPL does not cover Install and Running the software by the end user- specifically becuase those uses are exempted by US copyright law in section 117. You can also use one disk to install multiple copies of the software legally and you can make copies of the software and give it away or charge for it if you think the market will bear a price for the software.
