The whole patent system is messed up.
NTP vs RIM is just one instance of the mess. The whole patent system is close to disaster. When we have so called "engineering/tech" companies like Rambus whose only source of income is litigation, lawsuits and patents, the patent system is a mockery, a joke. Thanks to the brain dead patent office and US courts, anyone can now sue anyone else for so called patent violations. Companies like Forgent networks claim to hold 'patents' on the JPEG format, and sue companies for that. This is ridiculous, and the US PTO and legal system is to blame for this.
