Easy, Obvious or Simple. It doesn't matter.
Even obvious doesn't matter. Nothing ventured, nothing gained. If the patent was obvious, why didn't you take it out. The reason is it wasn't obvious. You didn't recognize the obviousness until it was defined in the patent. In other words he beat you to it and everyone else. He just cannot patent something on the market older than 366 days or it is prior art.

This is because the Patent Office doesn't have software programmers working there to recognize prior art. This is not a failure of patents but the failure of knowledge. Any system will break down in the hands of folks ignorant of the subject.

There has to be a working model like they use to have. The P.O. quit giving patents on perpetual motion machines because they don't work. Same thing with software. The software folks should havea working model instead of patenting a theory.

As for 17 years that is a little lengthy but as software evolves and becomes more time consuming to deliver, 17 years is not too bad. 12-15 years would be OK to start out at this point.
