Actually, GPL'd software is totally open and totally free. You can make as many copies as you want, and distribute tham in any manner that you wish to as many as you wish. You may modify the source code as it pleases you or as you need to for use in your organization. I think that your definition of encumbrance refers to the prohibition against closing the source, renaming the software, and selling it as your own work. This you cannot do with GPL'd software. If you want to call not getting your wanted free ride an encumbrance, go ahead.
